What is the applicable reference legislation?

The applicable reference legislation is represented in particular by Regulation (EU) No 517/2014 on fluorinated greenhouse gases, Presidential Decree No 146 of November 16, 2018, which implements said regulation at national level, and Legislative Decree No 163 of December 5, 2019, which contains the discipline of sanctions for the violation of the obligations under Regulation (EU) No 517/2014.

What are the registration and reporting obligations envisaged?

Under the applicable legislation, companies that supply non-hermetically sealed equipment containing fluorinated greenhouse gases to end users are required to:

register in the national electronic Registry of fluorinated gases; and
report the sales data of the equipment to the national fluorinated gases Database.

What do I have to do to sell these items on Amazon.it?

In order to sell non-hermetically sealed equipment charged with fluorinated gases on Amazon.it and to ensure compliance with the applicable legislation regarding sales data reporting obligations, you are required to register in the national electronic Registry of fluorinated gases and report the required data, for each sale, at the time of the sale and electronically, to the national fluorinated gases Database.

Important: In order to ensure that the necessary information is obtained at the time of sale, as required by applicable legislation, the customer's declaration that the installation will be carried out by a certified company, together with information on the customer’s personal details, must be obtained before the equipment is shipped to the customer
