Our Product has been Flagged and Amazon is requesting an EPA exemption number

Caseid14421111971

We have tried everything we could think of to remove most of the listing information and anything that could flag us, but we still keep getting the same response back, which has not been helpful.

We have verified and also confirmed with our manufacturer that this product does not require to be registered with the EPA. If anyone could help us better understand what we need to do to get this listing active, it would be greatly appreciated.

Amazon support replies back with this:

"1. Please provide the pesticide product's EPA registration number or EPA Establishment number by updating the Pesticide Marking Attribute.

2. Alternatively, if you believe your product is exempted, please provide evidence of exemption from registration and update the Pesticide Marking Attribute with the correct selection. Evidence of exemption from registration may include proof of state pesticide registration as an EPA-exempt product. "

I have had to get the executive seller support relations team involved in these cases, as the regular support team doesn't even look at the products and keeps demanding a registration number that doesn't exist.

Common sense doesn't prevail with Amazon regular seller support anymore.

Hi @Seller_R6T9fjqQ4jKpW,

Thank you for your post. Based off the information you have provided, it seems as though you are dealing with a restricted product violation specifically due to pesticide claims. These violations are usually triggered by some kind of keyword or phrase. Therefore, editing the listings to remove the keywords is one way to dispute the violation.

What action have you taken so far? What information have you submitted as a result of said action? Any changes you make to remove keywords from the listing will need to be documented via a written explanation of the actions you have taken to resolve the issue. In the case of pesticide claims, often words such as "anti-bacterial" or "anti-microbial" can trigger a violation. Replacing words such as this can be a way to resolve the issue.

In addition to documenting your changes, you may also want to provide photographs of the product itself. It is recommended to provide photos of the packaging as well as the actual product (for example, if your product is a bottle of pills, provide a photo of each panel of the box containing the bottle as well as the bottle itself). These photos should show that no pesticidal claims are being made on the label. A photo clearly showing the product ingredients can also be helpful (especially if there is a specific ingredient that need to be addressed or proven that it is NOT present within your product).

What proof did you receive from the manufacturer? Did you send in this information along with the remainder of your prior submissions? If your product falls under an exemption, please provide documented proof of this. Screenshots from the FDA or EPA websites (along with corresponding URLs) and/or certifications showing the exemption are examples of what would be required in this case. There may be also additional information that needs to be added to the listing's Product Detail Page so that buyers are aware that this is not a pesticidal product (based off the quotation from the case log you shared in your post).

Have you followed the guidance you have shared here? If so, what is the status of your current submission? We would need to allow the review team to complete their investigation prior to taking further action if the evaluation is still in progress. With this in mind, please consider the preceding guidance as a way to begin preparing a new plan of action should one be necessary.

Please feel free to reach out with any further questions or account updates, and we will assist you as best we can.

Regards,

Troy
