Need help with brand registry

Hello, new seller with zero experience here. I need some help so that I can move forward with my brand registry (BR) application.

I submitted my trademark registration myself to USPTO in April and in May I submitted a BR application. The initial response was fairly quick. Three days after my application I received a message requesting me to schedule a video verification within the next 2 weeks. That’s when the things started to get dramatic. I was requested to show at least 50 units during the video verification. However, back then I was evaluating the sample product that my contractor sent to me and wouldn’t have 50 units within the next 2 weeks. So I didn’t schedule the video verification and instead replied the email where I requested to extend the deadline to mid June. However, it looks like that no one in the BR team read my email and after the original deadline for verification my application was rejected.

Early this month I submitted a second application with the same material. One week later the application was rejected saying the BR team determined that I was not the brand owner. But I am and I submitted the trademark application receipt from USPTO in the application. There was no such issue in my first application. In the rejection email it said that if I believe there is an error in the BR team’s rejection, I could resubmit my application.

So I submitted a third application. And it was instantly rejected and the system said I became ineligible. After reading the email there seems to be a path forward by appealing. So I appealed and submitted the requested docs. The next day my appeal was rejected with a very generic letter saying the rejection was due to one of 6 broad reasons, which I think none applied to my case. I replied in the case log asking for more specific reason but so far one week passed and I didn’t receive any reply yet.

I really hope to have my brand registered. My case should be fairly simple but it seems there is a lot of ambiguity and black box arbitrary decision-making in the brand registry.

Would someone please point out a path forward for me? I am not sure if the BR team would follow up my request for more specific info in the case log as my email in the first application was apparently ignored. Asking support from the BR team is not an option as that requires at least one registered brand. Is there a way to escalate this issue and hopefully someone in the BR team could evaluate my case more carefully and if needed give me more specific instruction to update my application?

If you have opened any cases provide a number so any MOD that happens to drop by can look it over to see if they can help.

Without a case number in the posts it wastes time for everyone. I no longer tag anyone if there is no case #.

They have to ask for it and then wait for a reply from the poster and then the poster has to wait again for the MOD to find the case, and then more waiting.…………....

In the meantime --

Go over everything with a magnifying glass looking for a missing 'period' or 'comma'.

Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?

When Amazon says something must match they mean EXACTLY!

That means Street is not ST.

Jim is not James.

ALL CAPS is not SOme CAps

My name is Dougal from the Community Manager Team and I would be happy to take a look at your Brand Registry enrollment application.

After reviewing the application associated with your appeal, as well as your other application decisions, I found that they all point to the same thing.

Without getting too technical, The Brand registry enrollment team cannot make a connection between you (the individual in the case correspondance and application submission) and the owner of the brand as listed in USPTO.

I hope this helps you better understand the reasons for enrollment rejection.
