A significant issue faced by sellers on Amazon is the practice of some listing creators incorporating their business names into product titles. This can lead to claims of ownership over the products listed, despite a lack of evidence supporting their production, importation, design, or actual ownership rights. For instance, a large toy brand’s products might be exclusively sold by an individual seller who is not affiliated with the brand’s company, simply because they have included their business name in the product title. This tactic is not uncommon on the platform.
Additionally, sellers may receive cease and desist communications, sometimes written in Chinese, from other sellers asserting rights over the listings and threatening legal action. These challenges have made listing products on Amazon increasingly difficult, to the point where some sellers have ceased listing new products for years.
It is essential for Amazon to address these concerns to ensure a fair and competitive marketplace for all sellers. Without a review and potential revision of these practices, the incentive for sellers to engage with the platform may continue to diminish.
